- Our contract templates provide for standard terms and conditions across many different types of procurement.
- At times you must use these, other times we recommend you do even though it’s not mandatory.
- Where you don’t use these templates you often have to include specific terms and conditions.
Use your agency's contract templates
If you're buying on behalf of a NSW Government agency, you must use its procurement templates.
Use ICT contract templates
NSW Government agencies must use the ICT Purchasing Framework to buy ICT related goods and services. It comprises:
- Core& Contracting Framework for low-risk ICT procurement up to the value of $1 million (excluding GST)
- MICTA/ICTA Contracting Framework for ICT procurement over $1 million (excluding GST) or high risk regardless of value.
Use construction contract templates
The construction contract template you use will depend on the size and complexity of the project, scope of works and specific agency commercial requirements.

Accredited agencies may draft own construction contracts
You can use our standard construction templates and guidelines if they’re suitable. However, if you draft your own contract, you must be sure to include clauses that:
- refer to the NSW Industrial Relations Guidelines, Building and Construction Procurement
- make suppliers comply with any relevant international or Australian standards
- allow for proper sharing and use of financial assessment reports
- force suppliers to comply with work health and safety, environmental management and quality management requirements.
