What you need to know
Quality
Food products will be of the best quality, with a taste, appearance and texture that customers find acceptable.
All products will be inspected and must be approved by the buyer. These specifications are the minimum standard for each product when delivered.
Food safety
All food suppliers are fully Hazard Analysis and Critical Control Point (HACCP) certified. This means their sourcing, production and delivery processes follow world’s best practices to ensure food safety.

All products supplied must comply with all relevant food safety laws and regulations in Australia. This includes, but is not limited to:

Additionally, all milk and dairy products must:
- Follow FSANZ Standard 4.2.4 Primary Production and Processing Standard for Dairy Products and state based Dairy Standards as applicable
- Be manufactured according to Australian Standard AS3993-2003 Equipment for the Pasteurisation of milk and other liquid dairy products – Continuous flow systems and
- Be tested against Australian Standard AS2300 Methods of Chemical and Physical Testing for the Dairying Industry for pasteurised products.

Who's eligible to buy
The food services contract is a mandatory, whole-of-government agreement.
All NSW Government agencies are eligible
This means that all NSW Government agencies are eligible to use – and must use – this contract when food services.
Non-agency buyers may also be eligible
You don’t have to be an NSW Government agency to buy under NSW Government contracts, panels and contracts.
But you do have to apply to become an eligible non-agency buyer. Once approved, you'll get an authorised buyer identification number (NSWBuy number). Use this number to buy through NSW Government schemes and contracts.

Print catalogues
The contracted supplier will provide catalogues of available products under the contract upon request at NSW Government contracted prices. These are free of charge to customers on a reasonable request basis and will primarily be accessed through the contracted supplier’s website.
The information in the catalogues will be regularly updated by the contracted supplier through website updates, newsletters and other bulletins to ensure that eligible customers are kept up to date on changes to the range of products available.

Prices for all products are free-in-store to customers within the supply regions defined for each supplier. Contract prices may change in accordance with the price variation conditions of the contract.
Competitive prices have been obtained through:
- aggregating food and distribution purchases across multiple government agencies to leverage volume discounts.
- engaging with suppliers to understand demand patterns and ordering frequencies, allowing them to optimise inventory management and pass on cost savings.
- implementing fixed-price periods that align with market volatility, ensuring stability and predictability.
- allowing price adjustments based on transparent, publicly accessible market indices.
- maintaining competitive tension among suppliers within each category to drive value.
- benchmarking supplier performance and pricing against publicly available data to ensure competitiveness.
Each contracted item has a specific and agreed index allowing price variations to be made fairly and efficiently, reflecting market trends. Healthshare NSW monitors these prices as part of its contract management role.
Contract orders
Buyers can order goods and services directly from the supplier.
When placing an order, the customer is entering into a binding contract with the supplier. The official order should include the following details:
- contract number and name: Food Services Contract 801
- name and address of supplier: refer above for approved category suppliers
- customer name and customer’s order number: include the customer's full name and unique order reference number.
- order and delivery dates: clearly specify the date of the order and the expected delivery date.
- item details: include product codes, contract prices, and quantities for each item ordered.
- delivery instructions: provide any specific delivery instructions or requirements.
Delivery
Standard deliveries
Deliveries should be available five days a week, including public holidays, in metropolitan areas, unless otherwise contracted. For areas outside the metropolitan region, a minimum of two delivery days per week is required.
Specific delivery days and times will be negotiated and agreed upon with the customer. Deliveries must occur during the customer’s facility operating hours.
For standard deliveries from the date of receipt of order, standard deliveries will be received:
- metropolitan: standard deliveries will be received within 24 hours of order receipt.
- regional: standard deliveries will be received within 48 hours of order receipt, unless previously agreed otherwise.
Emergency deliveries
Unless otherwise specified by the supplier, emergency deliveries from the time of receipt of order will take place:
- metropolitan: within 6 hours
- regional: within 24 hours, depending on location.
Replacement deliveries
In the event of goods being rejected, supply will be:
- metropolitan: In the event of rejected goods, replacements will be delivered within 4 hours.
- regional: 24 hours, depending on location.
Delivery conditions
- All products must be transported in vehicles licensed by Safe Food NSW or another relevant regulatory authority.
- Delivery of frozen products must be coordinated with the customer, ensuring all frozen items remain at the correct temperature during transport and delivery. Vehicles must be equipped with temperature gauges, which may be checked and recorded by customers upon delivery.
- Delivery staff should be appropriately always dressed and maintain a professional demeanor.
- Suppliers should be aware that assistance for off-loading goods may not be available at the delivery point.
- Some buildings may require special access arrangements, and it is the supplier’s responsibility to determine these requirements before delivery.
- Goods must not be left unattended at the receiving area unless specific arrangements have been agreed upon between the customer and supplier.

Nominee purchasing
Nominee purchasing (also called third-party purchasing) refers to when a supplier buys goods or services from a third-party supplier to fulfil their contractual obligations to NSW Government.
