MICTA/ICTA contracting framework

Mandated contracting framework for ICT procurements that are high risk or over $1 million.


The MICTA/ICTA contracting framework is part of the ICT Purchasing Framework.

It is mandated by Procurement Board Direction PBD 2021-02 for ICT procurements that are high risk or valued over $1 million (ex GST).

Manage pre 1 September 2021 contracts

Contracts executed prior to 1 September 2021 will continue on the same terms until expiry, unless and until the supplier and agency vary the contract to include MICTA/ICTA terms and conditions.

If a pre-1 September 2021 contract is extended or renewed in accordance with its terms after 1 September 2021, the contract continues on the same Procure IT v.3.2 (or earlier) terms unless the supplier and agency agree in writing otherwise.

Approval from DCS is required to vary a Procure IT contract so as to extend its terms (rather than moving to a MICTA/ICTA Purchasing Framework) where there are no remaining options to extend.

Using pre 2 December 2024 contracts

The contracts released on 2 December 2024 include updated modern slavery provisions in line with the NSW Anti-slavery Commissioner's Guidance on Reasonable Steps to Manage Modern Slavery Risks in Operations and Supply-Chains (GRS). They reflect best practice for buyers and suppliers. Reporting for NSW Government on the use of the GRS Model Clauses is expected to be mandatory from July 2025. Buyers are encouraged to start using the updated contracts and implement the requirements within the GRS as soon as possible.

The updated contracts impose additional responsibilities on buyers and suppliers, particularly  hardware suppliers. DCS encourages buyers and suppliers to carefully review the updated contracts to ensure all parties are aware of their modern slavery obligations.
